Not likely. They would have to show a substantial change in circumstances to do so. You should hire an attorney if you haven't already done so.

They might. But, they would have to show changed circumstances. The new charge wouldn't really qualify unless its consideerably more serious. (e.g. you were arrested for petty theft and then charged with murder)
