Drug Crimes

Depending on whether charges are filed in state or federal court, the penalties and sentences vary dramatically. Your criminal attorney will determine the best method of defense for the applicable court. In state court, the penal code sets out the sentencing ranges, although there are enhancements in most cases that may apply.   In federal court, sentencing is handled by the federal sentencing guidelines.   Departures both upward and downward will apply.

In state court, Drug Diversion programs, commonly called "PC 1000" for the California Penal Code section that explains the program, may be available to first offenders.  This will result in the eventual dismissal of the criminal charges after the completion of an educational program and remaining law-abiding for two years.

"Prop 36"  law was enacted by California voters to place repeat offenders in rehabilitation in lieu of jail.  Who is eligible for treatment under this law can often times be difficult to determine, thus it is crucial to retain a qualified criminal attorney.
